These Terms constitute a legally binding agreement between you and MyShade ("we", "us", or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

By submitting content to the Service (such as photos for shade matching or chat messages), you grant us a limited licence to process that content solely for the purpose of providing our services to you. We do not claim ownership of your content.

Photos submitted for shade matching are processed in real-time and are not stored or retained after analysis is complete. The App requests access to your device camera and photo library exclusively for shade matching. You can revoke these permissions at any time through your device settings.

You are responsible for ensuring that any content you submit does not violate any applicable law or infringe upon the rights of third parties.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy forms part of these Terms.

We process your personal data in accordance with the Australian Privacy Act 1988, the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) where applicable. These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

If you are a consumer in the European Union, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyShade regarding your use of the Service and supersede all prior agreements, understandings, and negotiations, whether written or oral.
